agency shall receive approval from the director before the agency begins
programming for a new facility that requires legislative approval under Section

(2) When requesting the director's approval,
the agency shall justify the need for initiating the programming process at
that point in time and also address the level of support for funding the
project soon after the program document is completed.
(3) The director may approve the programming
of a new facility before the Legislature makes an appropriation for the new
facility under Subsection

When the program is funded by the agency, programming funds may be reimbursed
from an appropriation if, at a later time, the Legislature funds the
programming.
