Utah Admin. Code R305-7-603 - Matters Governed by Title 19, Chapter 1 of the Environmental Quality Code, but not Including Title 19, Chapter 1, Part 4
(1) Scope. This subsection R305-7-603 applies
to all matters governed by Title 19, Chapter 1, of the Environmental Quality
Code.
(2) Definitions.
"Director" shall refer to the Executive Director.
(3) Orders and notices issued
under the authority of Title 19, Chapter 1 of the Environmental Quality Code
are not exempt from the requirements of UAPA. The provisions of UAPA and of
Parts 1, 4 and 6 of this Rule shall apply to proceedings initiated under the
authority of Title 19, Chapter 1, the "Environmental Quality Code."
(4) Initiating and intervening in a
proceeding. Nothing in this Rule constitutes authority for any person other
than the agency to initiate adjudicative proceedings under Title 19, Chapter 1.
Nothing in this Rule constitutes authority for any person to intervene in an
action commenced under Title 19, Chapter 1.
(5) Proceedings under Title 19, Chapter 1 of
the Environmental Quality Code, and specifically under Section19-1-202(2)(a),
will be conducted formally under UAPA.
(6) Agency review under Section
63G-4-301
is not available. A request for reconsideration may be filed under Section
63G-4-302.
