Utah Admin. Code R307-415-7b - Permit Issuance: Requirement for a Permit
(1) Except as provided in R307-415-7 d and
R307-415-7 f(1)(f)and 7f(2)(e), no Part 70 source may operate after the time
that it is required to submit a timely and complete application, except in
compliance with a permit issued under these rules.
(2) Application shield. If a Part 70 source
submits a timely and complete application for permit issuance, including for
renewal, the source's failure to have an operating permit is not a violation of
R307-415 until the director takes final action on the permit application. This
protection shall cease to apply if, subsequent to the completeness
determination made pursuant to
R307-415-7a(3),
and as required by R307-415-5 a(2), the applicant fails to submit by the
deadline specified in writing by the director any additional information
identified as being needed to process the application.
