Utah Admin. Code R315-261-20 - Characteristics of Hazardous Waste - General
(a) A solid waste, as defined in Section
R315-261-2,
which is not excluded from regulation as a hazardous waste under Subsection
R315-261-4(b),
is a hazardous waste if it exhibits any of the characteristics identified in
Sections R315-261-20 through 24.
(b) A hazardous waste which is identified by
a characteristic in Sections R315-261-20 through 24 is assigned every EPA
Hazardous Waste Number that is applicable as set forth in Sections R315-261-20
through 24. This number shall be used in complying with the notification
requirements of section 3010 of RCRA and all applicable recordkeeping and
reporting requirements under Rules R315-262 through 265, 368 and 270.
(c) For purposes of Sections R315-261-20
through 24, the Board shall consider a sample obtained using any of the
applicable sampling methods specified in appendix I of Rule R315-261 to be a
representative sample within the meaning of Rule R315-260.
