Utah Admin. Code R432-270-6 - Licensee
(1) The licensee shall:
(a) ensure compliance with each federal,
state, and local law;
(b) assume
responsibility for the overall organization, management, operation, and control
of the facility;
(c) establish
policies and procedures for the welfare of residents, the protection of their
rights, and the general operation of the facility;
(d) implement a policy that ensures the
facility does not discriminate on the basis of race, color, sex, religion,
ancestry, or national origin in accordance with state and federal
law;
(e) secure and update
contracts for required services not provided directly by the
facility;
(f) respond to requests
for reports from the department; and
(g) appoint, in writing, a qualified
administrator who shall assume full responsibility for the day-to-day operation
and management of the facility. The licensee and administrator may be the same
person.
(2) The licensee
shall implement a quality assurance program to include a quality assurance
committee. The committee shall:
(a) consist
of at least the facility administrator and a health care professional;
and
(b) meet at least quarterly to
identify and act on quality issues.
(3) If the licensee is a corporation or an
association, it shall maintain an active and functioning governing body to
fulfill licensee duties and to ensure accountability.
