Utah Admin. Code R432-6-5 - Codes and Code Compliance
(1) The
following codes and standards enforced by other agencies or jurisdictions apply
to assisted living facilities. The licensee shall obtain documentation of
compliance for the following codes and standards from the authority having
jurisdiction and submit the documentation to the Department:
(a) Local zoning ordinances;
(b) International Building Code;
(c) International Plumbing Code;
(d) International Fire Code;
(e) International Mechanical Code;
and
(f) National Electrical Code,
NFPA 70.
(2) The
licensee shall obtain a certificate of occupancy from the local building
official having jurisdiction.
(3)
The licensee shall obtain a certificate of fire clearance from the Fire Marshal
having jurisdiction.
(4) The
licensee shall submit a copy of the certificates to the Department prior to
resident utilization of newly constructed facilities, additions or remodels of
existing facilities.
(5) Where
portions of the building are required to be accessible to persons with
disabilities, they shall comply with the Americans with Disabilities Act and
Architectural Barriers Act Accessibility Guidelines (ADA/ABA- AG).
