Utah Admin. Code R510-200-19 - Confidentiality
(1) Files maintained by the ombudsman program
shall only be disclosed at the discretion of the ombudsman.
(2) The identify of a complainant or resident
of a long-term care facility may not be disclosed by the ombudsman unless one
of the following occurs:
(a) the complainant
or reside, or the legal representative of either, consents in writing, orally,
or through the use of auxiliary aids and services to the disclosure;
(b) disclosure is ordered by a court;
or
(c) the disclosure is approved
by the ombudsman and is made, as part of an investigation involving the
resident, to an agency that:
(i) has
statutory responsibility for the resident;
(ii) has statutory responsibility over the
act alleged in the complaint;
(iii)
can assist the ombudsman or local ombudsman entity to achieve resolution of the
complaint; or
(iv) can provide
expertise that would benefit the resident.
