Utah Admin. Code R608-1-15 - Procedures For De novo Review
A. If,
in accordance with the provisions of these rules, a de novo review proceeding
is to be conducted by the Commission's Adjudication Division, the following
standards apply:
1. The Division shall refer
the matter to the Adjudication Division, which shall designate an
Administrative Law Judge to serve as presiding officer;
2. The proceeding shall be conducted as a
formal agency adjudicative proceeding pursuant to the relevant provisions of
the Utah Administrative Procedures Act, Title 63G, Chapter 4;
3. Within 30 days from referral, the
Administrative Law Judge shall schedule an evidentiary hearing to be held
within 120 days of the referral, unless it is impracticable to do so;
4. Any aggrieved party may intervene in the
action;
5. The Commission shall
make final administrative disposition of the complaint within one year after
the complaint is filed unless it is impracticable to do so. If the agency is
unable to make a final administrative disposition within one year, the
Commission shall notify the parties in writing of the reason for the
delay.
B. If, in
accordance with the provisions of these rules, a de novo review proceeding is
to be conducted in court, the following standards apply:
1. If, pursuant to Rule
R608-1-14,
the Commission has concluded the Director's Determination is supported by
substantial evidence, the Commission shall commence a court action to support
the Determination. Such action shall be commenced within 30 days from the date
of the election for court review.
2. If, pursuant to Rule
R608-1-14,
the Commission has concluded the Determination is not supported by substantial
evidence, the Commission shall not commence a court action to support the
Determination. In such case, the complainant may commence a civil action in a
court of competent jurisdiction as provided by the Act.
