Utah Admin. Code R65-11-3 - Board
(1) The board shall consist of five members
of the sheep industry, the commissioner, and a non-voting member representing
higher education.
(2) The original
members of the board shall be selected by the commissioner from a list
submitted by the industry.
(3)
Successors to original members shall be appointed by the commissioner from
names submitted by the industry.
(a) Two
members shall be appointed for three years.
(b) Three members shall be appointed for four
years.
(c) After the first three
years, each appointed member shall serve for four years.
(d) This rotation shall be in effect for the
term of the marketing order.
(e) In
the event of a vacancy, the commissioner shall appoint a new member from names
submitted by the board.
(4) Members of the board shall only succeed
themselves once and not serve on the board for more than eight consecutive
years.
(5) The commissioner shall
serve as chair of the board.
(6) A
majority of the board members, plus the chair, shall constitute a quorum. Each
decision of the board shall be by majority vote.
(7) Each member of the board may receive a
per diem and expenses in accordance with Sections
63A-3-106 and
63A-3-107. No member of the board
shall receive a salary.
(8) With
the commissioner's approval, the board may establish policies necessary and
incidental to the administration of this rule.
(9) The board shall meet at least
quarterly.
