Utah Admin. Code R65-5-3 - Board of Control
(1) The board of
control shall consist of seven members plus the commissioner or the
commissioner's designee.
(2)
(a) The commissioner shall select the
original board members from a list of names submitted by the
industry.
(b) The board shall
consist of:
(i) three producer members and
one processor member appointed for a term of four years; and
(ii) two producer members and one processor
member are appointed for two years.
(A) the
appointed term shall be four years after the first two years.
(B) Board members may be appointed for repeat
terms.
(3) The commissioner shall appoint successors
to original members from names submitted by the industry.
(4) Board members may not receive a salary,
but each may receive a per diem and travel expenses in accordance with Sections
63A-3-106 and
63A-3-107.
(5)
(a) A
majority of the board members plus the chair shall constitute a
quorum.
(b) Each decision of the
board shall be by majority vote.
(6) A designee from the Agricultural
Cooperative Association may serve as an ex officio member to complete the
duties of the board.
