Utah Admin. Code R651-700-6 - Land Acquisition
(1) The division
may acquire real property through all legal means.
(2) For purposes of this Section
R651-700-6, an acquisition of
land shall constitute acquiring fee or other title to land.
(3) Only the division director or deputy
director, if designated by the division director, may sign real property
contracts and deeds.
(4) The
director shall designate a team of division employees to conduct an on-site
inspection of real property the division proposes to purchase or acquire by
donation. state parks employees designated by the director.
(5) The director may, at the director's
discretion, request preparation of a title report or land survey for all
proposed land acquisitions.
(6)
After receiving the preliminary title report, the Lands and Environmental
Coordinator may request a review by the Attorney General's office.
(7)
(a) A
title company may conduct the closing of a real property transaction.
(b) If a title company conducts the closing,
the division shall instruct the title company to record the deed and send the
recorded deed to the Lands and Environmental Coordinator.
