Utah Admin. Code R68-7-5 - Classification of Pesticides
(1) The
department shall classify each pesticide product registered in Utah for either
restricted use or general use according to standards consistent with FIFRA
Section 3.
(2) The department may
also classify other substances as pesticides or restrict the use of any
substance as a pesticide if the department determines, in its sole discretion,
that such a substance may pose a risk to the health or safety of the public or
the environment.
(3) Restricted use
pesticides shall not be used by any person that does not have a valid pesticide
applicator license with the appropriate category for its use, except they may
be used by:
(a) a pesticide handler,
supervised by a certified pesticide applicator under the EPA WPS and who meets
the qualifications in Subsection
R68-7-6(6);
or
(b) a pesticide handler acting
upon an Emergency Use Permit issued under this rule.
