Utah Admin. Code R70-540-13 - Revocation
(1) The Commissioner may revoke a
registration whenever:
(a) the Commissioner
is unable to conduct inspections in accordance with this chapter due to
circumstances within the control of the registration holder or
person-in-charge; or
(b) the
registration has been suspended more than three times within a twelve-month
period.
(2) The
procedures for revocation are as follows:
(a)
the Commissioner shall notify the holder of the registration or the designated
person-in-charge, in writing, when a registration is to be revoked;
(i) the Commissioner shall state specific
reasons for which the registration is to be revoked; and
(ii) the Commissioner shall offer an
opportunity to a person whose registration is revoked for an informal hearing
as per
R51-2-6, provided a
written request for an informal hearing is filed with the Commissioner by the
registration holder, not later than ten business days after receipt of the
notice.
(b) a person
whose registration has been revoked may reapply thirty days after the date of
revocation. Application fees for a new registration will apply.
