Utah Admin. Code R708-48-17 - Interlock Restriction Extensions
(1) The division may not extend an
individual's ignition interlock restriction more than one 60 day extension for
violations in a given 60 day reporting period regardless of the frequency of
the electronic notifications received by the division under Subsection
53-3-1007(2).
(2) The provider submitting electronic
notifications to the division under Subsection
53-3-1007(2)
shall submit no more than one every 30 days and no less than one every 60 days
except upon removal of an ignition interlock system.
(3) The individual may request a hearing
before the division within ten days of the notice of extension regarding the
extension to challenge the report.
(4) The division shall conduct the hearing in
accordance with Rule R708-35. The burden of proof is on the individual to show
they did not violate Subsection
53-3-1007(2)(b)
or Subsection
53-3-1007(2)(c).
(5) The division may reference previous
violations during a hearing under this section.
