Utah Admin. Code R746-1-601 - Identification of Information Claimed to Be Confidential or Highly Confidential in Commission Proceedings
(1) A party to
a docket may request that information provided to another party or included in
the record be treated as confidential by:
(a)
placing the information on a document with yellow background;
(b) highlighting the information with
shading, text boxes, borders, asterisks, or other conspicuous formatting;
and
(c) including the following
designation, as applicable, on each page containing confidential information:
(i) "CONFIDENTIAL - - SUBJECT TO UTAH PUBLIC
SERVICE COMMISSION RULES
R746-1-602 and 603";
or
(ii) "CONFIDENTIAL - SUBJECT TO
PROTECTIVE ORDER".
(2)
(a) A
person that files or is requested to provide information that the person
considers to be highly confidential shall promptly:
(i) negotiate with the other parties mutually
agreeable protections; or
(ii)
petition the Commission for an order granting additional protective
measures.
(b) The
petitioning party shall set forth:
(i) the
particular basis for the claim;
(ii) the specific, additional protective
measures requested, which may include restricting or prohibiting specific
individuals from accessing information; and
(iii) the reasonableness of the requested,
additional protection.
(c) Any other party may oppose the petition
or propose alternative protective measures.
(d) If the Commission grants a petition for
additional protective measures, the party providing the highly confidential
information shall:
(i) place the information
on a document with a pink background;
(ii) highlight the information with shading,
text boxes, borders, asterisks, or other conspicuous formatting; and
(iii) include the following designation, as
applicable, on each page containing highly confidential information:
(A) "HIGHLY CONFIDENTIAL - - SUBJECT TO UTAH
PUBLIC SERVICE COMMISSION RULES
R746-1-602 and 603";
or
(B) "HIGHLY CONFIDENTIAL -
SUBJECT TO PROTECTIVE ORDER".
(3) A person that files with the Commission a
document containing confidential or highly confidential information shall:
(a) file a redacted version for public
access; and
(b) ensure that the
line numbering and formatting in the redacted version match, as closely as
practicable, that appearing in the unredacted version.
