Utah Admin. Code R994-405-302 - Failure to Accept a Referral
(1)
Definition of a Referral. A referral occurs when the department provides
information about a job opening to the claimant and the claimant is given the
opportunity to apply. The information must meet the requirements of
R994-405-301(2)(b).
(2) Failure to Accept a Referral. A claimant
fails to accept a referral when he or she prevents or discourages the
Department from providing the necessary referral information. Failing to
respond to a notice to contact the Department for the purpose of being referred
to a specific job is the same as refusing a referral for possible
employment.
(3) If there was a
suitable job opening to which the claimant would have been referred, benefits
will be denied unless good cause is established for not responding as directed,
or the elements of equity and good conscience are established.
