Utah Admin. Code R994-405-402 - Elements Necessary for a Disqualification
All of the following elements must be present before a disqualification will be assessed under Subsection 35A-4-405(4):
(1) the claimant's unemployment must be the
result of an ongoing strike,
(2)
the strike must involve workers at the factory or establishment of the
claimant's last employment;
(3) the
strike must have been initiated by the workers,
(4) the employer must not have conspired,
planned or agreed to foment the strike,
(5) there must be a stoppage of
work,
(6) the strike must involve
the claimant's grade, group or class of workers, and,
(7) the strike must not have been caused by
the employer's failure to comply with State or Federal laws governing wages,
hours or other conditions of work.
