Utah Admin. Code R994-405-803 - Educational Institution (School)
(1) To
be considered an educational institution it is not necessary the school be
non-profit or that it be funded or controlled by a school district. However,
the instruction provider must be sponsored by an "institution" that meets all
of the following elements:
(a) An institution
in which participants, trainees, or students are offered an organized course of
study or training designed to transfer to them knowledge, skills, information,
doctrines, attitudes or abilities from, by or under the guidance of an
instructor or teacher.
(b) The
course of study or training is academic, technical, trade, or preparation for
gainful employment in an occupation.
(c) The instruction provider is approved or
licensed to operate as a school by the State Board of Education or other
government agency authorized to issue such license or permit.
(2) Head start programs operated
by community based organizations, Indian tribes, or governmental associations
as a side activity in a sponsorship role do not meet the definition of
educational institution and therefore are not subject to the disqualifying
provisions of this rule.
