W. Va. Code R. § 97-6-22 - Criminal prosecutions for non-payment of support
22.1. Both state and federal laws make failure to provide financial support to a child a crime if certain specific facts exist. If a case meets the statutory requirements for possible prosecution under either state or federal law, the bureau attorney assigned to the case may refer the case to state or federal prosecutors.
22.2. W. Va. Code §
48-18-131 permits the bureau to release information to state or federal prosecutors and law enforcement officials as necessary for the purpose of establishing, modifying, enforcing or collecting a support obligation. The bureau shall not release information to state or federal prosecutors and law enforcement officials for any other purpose, except as set forth in 45 C.F.R. §303.15.
22.3. The bureau attorney assigned to the case shall approve all information released to state and federal law enforcement officials and prosecutors related to criminal non-support allegations.
