11 U.S. Code § 1221 - Filing of plan

The debtor shall file a plan not later than 90 days after the order for relief under this chapter, except that the court may extend such period if the need for an extension is attributable to circumstances for which the debtor should not justly be held accountable.

Amendments

1993—Pub. L. 103–65 substituted “the need for an extension is attributable to circumstances for which the debtor should not justly be held accountable” for “an extension is substantially justified”.

Effective Date of 1993 Amendment

Pub. L. 103–65, § 3, Aug. 6, 1993, 107 Stat. 311, provided that:

“(a) Effective Date.—
Except as provided in subsection (b), this Act [amending this section and provisions set out as a note under section 581 of Title 28, Judiciary and Judicial Procedure] and the amendments made by this Act shall take effect on the date of the enactment of this Act [Aug. 6, 1993].
“(b) Application of Amendment Made by Section 2.—
The amendment made by section 2 [amending this section] shall not apply with respect to cases commenced under title 11 of the United States Code before the date of the enactment of this Act.”
