42 U.S. Code § 3537b - Designation of environmental review procedure

(a) In general

Except as provided in subsection (b), the Secretary may, for purposes of environmental review, decision making, and action pursuant to the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.), and other provisions of law that further the purposes of such Act, designate the treatment of assistance administered by the Secretary as funds for a special project for purposes of section 3547 of this title.

(b) Exception

The designation described in subsection (a) shall not apply to assistance for which a procedure for carrying out the responsibilities of the Secretary under the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.), and other provisions of law that further the purposes of such Act, is otherwise specified in law.

A prior section 3537b, Pub. L. 89–174, § 13, as added Pub. L. 101–235, title I, § 112, Dec. 15, 1989, 103 Stat. 2016; amended Pub. L. 102–550, title IX, § 926, Oct. 28, 1992, 106 Stat. 3885, related to registration of and reports by persons spending money to influence Department decisions, was repealed by Pub. L. 104–65, § 11(b)(1), Dec. 19, 1995, 109 Stat. 701.

Applicability Date of Designation of Assistance

Pub. L. 119–101, title II, § 205(c), July 11, 2026, 140 Stat. 870, provided that:

“(1) In general.—

Except as provided in paragraph (2), a designation of assistance under section 13 of the Department of Housing and Urban Development Act [42 U.S.C. 3537b], as added by subsection (a), shall only apply with respect to funds appropriated after the date of enactment of this Act [July 11, 2026].

“(2) Exception.—

If a grantee of assistance administered by the Secretary of Housing and Urban Development combines funds appropriated before and after the date of enactment of this Act to carry out a project, section 13 of the Department of and Urban Development Act, as added by subsection (a), shall not apply to that assistance.”
