Labour Code of Saint Lucia, Part II Fundamental Principles of Employment, Section 7 General Prohibition Against Discrimination

Section 7(1) of the Labour Code of Saint Lucia prohibits employers from discriminating against employees based on race, color, sex, religion, national origin, social origin, ethnic origin, political opinion or affiliation, age, disability, serious family responsibility, pregnancy, marital status or HIV\AIDS status.

Section 139 of the Criminal Code makes it a criminal offense for an employer or a supervisor to create the impression that an employee must accept or tolerate sexual advances or sexually suggestive comments or behavior in order to avoid negative consequences at work. This also applies to prospective employers who create the impression that job applicants must do the same to be hired or to receive certain job conditions.

Section 133 of the Criminal Code makes anal intercourse between one man and another man (buggery) a criminal offence. Buggery is punishable by life imprisonment if committed with force and without consent, or ten years imprisonment in any other case.

Section 123(1) of the Criminal Code provides that a person who engages in sexual intercourse with another person (i) without that person's consent, or (ii) without believing that the other person has consented, or who is reckless as to whether the other person consents, commits the offence of rape and is subject to imprisonment for life.

For the offences of murder or manslaughter, Section 82(1) of the Criminal Code states that a child is considered a "person" once born and existing independently of the mother. Section 82(2) states that the offences of murder or manslaughter against such a "person" may be based on injuries inflicted before the child meets the legal definition of a "person."

The defendant was prosecuted for two separate rapes of female minors, aged 16 and 13 respectively. In each case, the defendant did not know the girls and used violence and force in the attacks, threatening to kill them if they screamed or moved. Following the first attack, DNA sampling of semen from the victim’s clothes did not return any matches, and the case went cold. In the second attack, available CCTV footage allowed police to identify the suspect.
