An ultimate fact is a logical conclusion derived from evidence presented during trial and is required for a claim or defense to be successful. An ultimate fact is usually inferred from a number of supporting evidentiary facts and is crucial to the outcome of the case.

Uncodified means a principle is not written in legislative laws or statutes, but rather, exists only by virtue of the common law. That is, uncodified refers to practices or rules that exist solely through judicial decisions.
Unconscionable is an adjective that means without a conscience; unscrupulous; so unfair or unjust that it shocks the conscience. The adjective is frequently used in the context of contract law for contracts that have grossly oppressive and unfair terms.
The undue burden test established by Planned Parenthood v Casey (1992), was overruled and made moot by Dobbs v Jackson Women’s Health Organization, in 2022.
