Iowa Code r. 199-45.12 - [Effective until 7/16/2025] Disputes
(1) A party shall
attempt to resolve all disputes regarding interconnection promptly and in a
good-faith manner. A party shall provide prompt written notice of the existence
of the dispute, including sufficient detail to identify the scope of the
dispute, to the other party in order to attempt to resolve the dispute in a
good-faith manner.
(2) An informal
meeting between the parties shall be held within ten business days after
receipt of the written notice. Persons with decision-making authority from each
party shall attend such meeting. In the event said dispute involves technical
issues, persons with sufficient technical expertise and familiarity with the
issue in dispute from each party shall also attend the informal meeting. If the
parties agree, such a meeting may be conducted by teleconference.
(3) Subsequent to the informal meeting
referred to in subrule 45.12(2), a party may seek resolution of any disputes
through the 199-Chapter 6 complaint procedures of the commission. Dispute
resolution under these procedures will initially be conducted informally under
rules 199-6.2 (476) through
199-6.4 (476) to reach
resolution with minimal cost and delay. If any party is dissatisfied with the
outcome of the informal process, the party may file a formal complaint with the
commission under rule
199-6.5 (476).
(4) Pursuit of dispute resolution shall not
affect an interconnection applicant with regard to consideration of an
interconnection request or an interconnection applicant's position in the
utility's interconnection review order.
