Kan. Admin. Regs. § 28-15a-851 - Requirements for the revised total coliform rule

The provisions of 40 C.F.R. 141.851 through 141.861, as in effect on July 1, 2015, are hereby adopted by reference with the alterations specified in this regulation.

(a) Exclusions. The following portions of 40 C.F.R. 141.851 through 141.861 shall be excluded from adoption:

(1) 40 C.F.R. 141.854(a)(4), (b), (c), (d), (e), (f), (g), and (h);

(2) 40 C.F.R. 141.855(b), (c), (d), and (e);

(3) 40 C.F.R. 141.856(b) and (c);

(4) 40 C.F.R. 141.857(b), (c), and (d); and

(5) 40 C.F.R. 141.859(a)(2)(iii).

(b) Modifications.

(1)

(A) In 40 C.F.R. 141.854(i)(2), the following text shall be deleted: "unless it meets the criteria in paragraphs (i)(2) (i) through (iii) of this section to be eligible for monitoring less frequently than monthly beginning April 1, 2016, except as provided under paragraph (c) of this section."

(B) In 40 C.F.R. 141.854(i)(3), the following text shall be deleted: "except that systems that monitor less frequently than monthly must still monitor during the vulnerable period designated by the State."

(C) In 40 C.F.R. 141.854(i), the following text shall be deleted from the first sentence: "collecting samples on a quarterly or annual frequency."

(D) In 40 C.F.R. 141.855(f), the following text shall be deleted from the first sentence: "collecting samples on a quarterly frequency."

(2)

(A) "Appendix A to subpart C of part 141" shall be replaced by "K.A.R. 28-15a-27."

(B) "Subpart H" shall be replaced by "K.A.R. 28-15a-70." "Subparts H, P, T and W" shall be replaced by "K.A.R. 28-15a-70, K.A.R. 28-15a-170, K.A.R. 28-15a-500, and K.A.R. 28-15a-700."

(C) "Subpart Q of this part" shall be replaced by "K.A.R. 28-15a-201."

(D) "Subpart S" shall be replaced by " K.A.R. 28-15a-400."

(E) "Subpart Y" shall be replaced by " K.A.R. 28-15a-851."
