N.H. Code Admin. R. Ins 1904.09 - Effective Date for Existing Contracts
(a) A
contract that provides health care benefits and that was issued before the
effective date of this rule shall be brought into compliance with this rule by:
(1) The later of:
a. The next anniversary date or renewal date
of the contract; or
b. Twelve
months following the effective date of this rule; or
(2) The expiration of any applicable
collectively bargained contract pursuant to which it was written.
(b) For the transition period
between the adoption of this rule and the timeframe for which plans are to be
in compliance pursuant to Subsection A, a plan that is subject to the prior COB
requirements shall not be considered a noncomplying plan by a plan subject to
the new COB requirements if there is a conflict between the prior COB
requirements under the prior rule and the new COB requirements under the
amended rule, the prior COB requirements shall apply.
