Chapter 338 ensures that Hawaii residents can obtain accurate and affirming identification documents that reflect their gender identity. Section 338-11.5 authorizes the Department of Health to issue new marriage certificates for individuals whose gender, sex designation, or name has changed.

Hawaii Revised Statutes Title 18 § 302A-461 guarantees gender equity in public high school athletics. This ensures that no student is excluded from participation in athletic activities, denied benefits, or discriminated against in school sports because of sex, in accordance with federal Title IX protections.

The Hawaii State Constitution provides strong guarantees for equality and personal freedom that form the basis of the state’s gender justice framework. Article I, Section 3 ensures equal legal rights for all regardless of gender identity, and prohibits the state from discriminating on the basis of sex.

The New York State Gender Recognition Act (GRA) was passed in 2021 for the purpose of removing excess burdens for LGBTIQ+ individuals seeking to change their names and sex designation marker on legal documents, as well as improving privacy protections for transgender individuals in New York State.

The New Mexico Human Rights Bureau is the enforcement mechanism for the New Mexico Human Rights Act.

The Reproductive and Gender Affirming Health Care Freedom Act (HB 7) was enacted in 2023 to amend Chapter 24 of New Mexico Statutes on Health and Safety. Chapter 24 governs statewide health, safety and medical services. The Act adds Article 34 and 35 to the Chapter to codify strong state-level protections for transgender and gender nonconforming people in the State. 

Created by the New Mexico legislature through Senate Joint Memorial 2 in February of 2024, the Missing and Murdered Indigenous Peoples Task Force is housed within the New Mexico Department of Justice. The task force investigates crimes involving missing and murdered indigenous peoples.

The plaintiff contacted Elane Photography, LLC (defendant) to photograph her commitment ceremony with her female partner. The defendant refused, explaining that same-sex commitment ceremonies conflicted with their personal beliefs. The plaintiff filed a complaint with the New Mexico Human Rights Bureau, who found the defendant to have discriminated against the plaintiff.

In Griego v. Oliver, 2014-NMSC-003, 316 P.3d 865, the New Mexico Supreme Court held that the State Constitution guarantees the right of same-sex couples to marry. The case arose when several same-sex couples, along with the American Civil Liberties Union (ACLU), challenged the refusal of county clerks to issue marriage licenses to same-sex partners.

In New Mexico Right to Choose/NARAL v. Johnson, 127 N.M. 654 (1999) the New Mexico Supreme Court held that a state regulation (Rule 766) limiting Medicaid funding for abortions to only cases of rape, incest, or life endangerment, violated the Equal Rights Amendment of the New Mexico Constitution (Art. II, § 18).
